In such cases, the customer shall only be entitled to a refund of the deposits less the accrued expenses.

29. In the following cases, the bet shall be invalid, or the betting contract shall be deemed to have been subsequently cancelled by mutual agreement, with the legal consequence that the bet stake must be paid back to the bettor:

a) If the betting event does not take place as stated in the odds sheet (e.g.: reversed home right), unless the home team - for whatever reason - exercises its home right at a foreign sports facility.

b) If the bet is placed after the actual start of the betting event on which the bet is based or not in accordance with the betting rules. However, this shall not apply to those bets which, due to their nature, are continuously offered by the bookmaker even after the start of the betting event and which are marked as such bets - which can be concluded even after the start of the betting event - such as, for example, long-term bets and live bets. The time of the conclusion of the betting contract determined by the bookmaker is binding for the bettor.

c) If an event is cancelled or does not take place, unless:

c a) at the time of the cancellation, an alternative date for this event has already been fixed, which is within the following two calendar days, calculated from the originally scheduled start of the event, or

c b) the event is postponed as part of a sporting tournament event (e.g. world, European or national championships, Olympics, tennis tournament, etc.).

d) If the event is abandoned without an official classification being made immediately after the abandonment. Subsequent changes to the ranking (e.g. decisions "at the green table" or by way of committee ruling) are therefore disregarded.

e) If a tennis match is ended by walk-over.

30. The following rules shall apply in particular to the assessment of the outcome of the bet:

a) The results announced immediately after the end of the betting event (e.g. presentation ceremony, if this takes place immediately after the betting event) shall be decisive.

b) In the case of soccer matches, the result after 90 minutes (regular playing time), in the case of ice hockey matches after 60 minutes (regular playing time) shall be decisive. Any extra time or penalty shoot-outs etc. therefore have no influence on the betting contract, unless the contracting parties have agreed otherwise by notation in the bookmaker's records (e.g. European Cup - promotion bet).

c) If two or more events of the same type (e.g. two giant slaloms) take place at one venue, all bets placed before the start of the first event shall be valid only for the first event, unless expressly agreed otherwise.

31. In the event of a "dead heat" (2 or more tied finishers), the payouts will be divided accordingly (e.g. bet 100, odds on the winner: 1.8, results in a payout of 180): Bet 100, odds on the winner: 1.8, results in a bet payout of 180, with two winners the payout is therefore 90 each, with three winners 60 each). If only two starters (teams) participate in betting events (e.g. training duel) and no draw odds are offered, the payouts are not divided in the case of "dead races", but the entire stake is paid back.

32. If the betting event takes place in accordance with these General Betting Rules and a participant or team does not take part in this event, the betting contract remains valid ("play or pay"). This means that a bet placed on a non-participant or on a non-participating team is deemed to be lost by the customer, except in the case of ‘Head-to-Head’ bets (see Supplementary Betting Rules).

33. if several betting events are combined ("combination bet"), the following shall apply:

a) If one or more events are cancelled, interrupted or do not take place for other reasons without an addendum within the meaning of item 29 c or without an official valuation within the meaning of item 29 d, these betting event(s) shall be valued at odds of 1.00; this shall also apply to tennis matches ended by w.o..

b) If all betting events are cancelled, interrupted or do not take place for any other reason without a supplement in the sense of point 29 c or without an official evaluation in the sense of point 29 d, the betting contract shall be cancelled retroactively, and the stakes shall be refunded. This also applies to tennis matches terminated by w.o..

c) If the contract is concluded only after the start of one or more events, odds of 1.0 shall apply to these events; this shall not apply to the bets listed in item 29 b, 2nd sentence. If the bet is placed after the start of all events, point 29 b shall apply mutatis mutandis.

34. prohibited bets according to § 11 StWttG Betting operators may not offer, place or arrange the following bets:

1. betting during an ongoing event (live betting), with the exception of live betting on the final result, the intermediate result and on which team will score the next goal in soccer and ice hockey;

If a customer plays several identical bets whose total win sum exceeds GW's win limit, the bookmaker has the unilateral right to reduce these bets to such an extent that the win limit is complied with. Since the win limit is known to the customer, GW is not liable in this case for possibly lost winnings. GW reserves the right to set limits that deviate from the above-mentioned win limits for individual customers at any time and without stating reasons.

1.6 Betting customer card

According to the StWttG, the betting company must issue a consecutively numbered betting customer card for each betting customer for the operation of a betting terminal and for bets whose stake exceeds an amount of € 50 upon presentation of a photo ID.

The following data must be noted on the betting customer card.

(1) The name of the betting company,

(2) card number,

(3) the name, the date of birth of the betting customer, as well as

(4) the date of issue.

Only one betting customer card is permitted per betting customer. This card always remains the property of GW. If you lose your betting customer card, you can apply for a new betting customer card, whereby the old betting customer card loses its validity. The bookmaker accepts no liability for misuse and use by unauthorized persons of your betting customer card. Therefore, it is expressly pointed out that the username and password must be treated confidentially, as all account transactions using these codes are for the account of the betting customer. The betting customer card is not transferable to other persons.

General information about the dangers of participating in betting for the emergence of gambling addiction and its negative effects.

We are interested in our customers betting responsibly and within their financial means. GW is aware of the fact that excessive participation in sports betting can lead to personal and social problems.

GW therefore consciously avoids excessive stimulation of the need to bet through advertising and marketing activities.

In order to guarantee you a responsible approach to sports betting, we offer the following options for your customer account.

Self-limits:

- Stake limits, both temporal and per betting slip.

- Deposit limit

- Loss limit

- Maximum session duration is an additional addiction prevention measure and serves to avoid a possible gambling frenzy or to interrupt it.

These self-limit features allow you to restrict the amount of money you deposit into your account or wager on bets so that the specified amount cannot be exceeded within one day, one week or 30 days.

You can further reduce the specified amount at any time. However, an increase is always only possible again after a certain period of time after the last reduction. Our customer service staff will be happy to provide you with more information but are not able to cancel the limits you have set.

You can also deactivate advertising/newsletters from GW at any time.

1.10 Betting Fee

Starting from April 1, 2025, a legally mandated betting fee of 5% on the stake will be applied in Austria.

Half of this fee will be passed on to the customer and automatically deducted from the stake for each bet placed.

1.10.1 Calculation of the Betting Fee

Example: A customer places a €10 bet (total stake). 2.5% of the stake is charged as a fee. The actual stake placed is: €10 - €0.25 = €9.75.

1.10.2 Calculation of the Betting Fee Shop

The betting fee is calculated based on the gross stake.

This means that the actual amount wagered (net stake) results from the total stake minus the betting fee.

Example: A customer places a €10 bet (total stake).
The actual net stake is: €10 * 0.95 ≈ €9.50
The betting fee is: €10 - €9.50 = €0.50

1.10.2 Important Notes on the Betting Fee:

The betting fee is charged regardless of the outcome of the bet. The customer has no right to a refund of the betting fee, neither in the event of a change or abolition of the legal regulation nor in the case of match cancellations, void bets, or other bet adjustments.

1.11 Matched Betting and Automated "Bots"

If it is determined that the customer is using techniques such as matched betting or automated "bots" for placing bets, we reserve the right to withhold any resulting winnings. Additionally, a fee of 10% of the deposit amount plus a processing fee of €10 will be charged.10 % Fee is charged for using KI Bots or Scripts.
